Fair Dealings

Considering the size of the internet, media and television there still remains relatively little accurate and trustworthy information for transgender people, educators and professionals. For this reason we attempt to draw together as much information as possible to help people in one place and not for profit. If you are the copyright owner and we have omitted to give you credit for your work please let us know. We accept many articles on trust and in good faith it is almost impossible to guarantee the honesty of the person who submits the article to us so we can only apologise and remove work upon request if a link is unsatisfactory.

Fair Dealings allows people to reproduce or otherwise use someone else’s copyright work for free and without permission as long as the use amounts to a “fair dealing” for a particular purpose. The permitted purposes are:

* for research or study
* for criticism or review
* to report the news
* to give legal professional advice.

The fair dealing ‘defences’ exist because public policy considers that the 'public interest' in allowing fair use of a person’s work for certain purposes is greater than a copyright owner’s interest in having absolute control over their work. Fair dealings used for the sole purpose of criticism and review in our case.

What is “criticism or review”?
The terms ‘criticism’ and ‘review’ mean to make some analysis or judgement about the quality of the thing being criticised or reviewed. Criticism may be strongly expressed and may also be made in a satirical or humorous way.

Criticism or review of a work
To be legal, use of a copyright work for criticism must be to criticise the work or another work – but not something else altogether. For instance, the criticism may be directed at the work being used - like where a poem is reproduced or photograph/s for the purposes of commenting on and critiquing them.

The dealing must be “fair”
" 'Dealing' with another person’s work must be “fair”. Foremost among these is that the motive of “criticism or review” is genuine.
